Liverpool fans rejoice at court decision

Tom Hicks and George Gillett have failed in their High Court attempt to wrest back control of Liverpool.

The unpopular American co-owners had tried to oust the boardroom rivals that had sanctioned the sale of the club to New England Sports Ventures (NESV).But Mr Justice Floyd ruled they did not have the power to do so.The decision means the sale to NESV can proceed, although club chairman Martin Broughton hinted rival bids may now be considered at a meeting on Wednesday.”I am absolutely elated, it’s a very important day for our club,” said Broughton as he left the Royal Courts of Justice in London.”This will clear the way for the sale, we will have a board meeting this evening and proceed with the sale.

DAVID BOND’S BLOG

“It has been an anxious time but we have been confident. But when you go to court you can never be sure.”He declined to confirm that NESV, owners of the Boston Red Sox, would be the new owners. He said: “The board has to be reconstituted and I can’t prejudge what the board is going to say. It would be inappropriate to prejudge what the board may say.

“But the club’s going to have a great future. We will re-establish the right basis for the club.”The acquisition debt that has been plaguing us will be gone, we have a great future. We will get the right owners for the fans.”John W Henry, who heads the NESV consortium, celebrated the High Court verdict through his Twitter account and praised Broughton managing director Christian Purslow and commercial director Ian Ayre.Henry wrote: “Well done Martin, Christian & Ian. Well done RBS. Well done supporters!”NESV said in a statement that it had a “binding agreement in place with the Board of Liverpool FC”.It went on: “We are ready to move quickly and help create the stability and certainty which the club needs at this time. It is time to return the focus to the club itself and performances on the pitch.”NESV is thought to be offering about £300m for the club, enough to pay back the £240m of loans and £40m of fees owed to Royal Bank of Scotland. Its bid has been accepted in principle by the club. But in recent days another bid has materialised, with Singapore billionaire Peter Lim offering £320m in cash for the club and its liabilities. He is also willing to provide £40m in cash to buy players.

I am not prepared to grant any relief… if I did it would risk stopping the sale and purchase agreement going ahead

Mr Justice Floyd

Following Wednesday’s High Court ruling, Lim issued a statement outlining his plans.”I welcome the decision of the court,” it read. “I hope that when the board is reconstituted tonight that it will not simply ratify a sale to NESV but will consider all the offers before them.”I am asking the board to run a full and fair process that enables all of the offers to be considered on their merits before the future of the club is decided.”I have delivered my offer to the board and believe that my ownership represents the best option for the future of the club and its supporters.”American hedge fund Mill Financial has a bid that also pledges to wipe out Liverpool’s debts while providing up to £100m to fund a new stadium.Mill Financial technically controls Gillett’s 50% stake after he defaulted on the loan used by the American to fund his part of the leveraged takeover in 2007.It is up to Broughton and his fellow board members to decide which bid to run with now they have won their High Court tussle.Hicks and Gillett had wanted an injunction to halt the sale negotiations but Mr Justice Floyd rejected the applications.”I am not prepared to grant any relief,” he said. “If I did it would risk stopping the sale and purchase agreement going ahead.”He added that it would be “inappropriate in the circumstances” for him to grant Hicks and Gillett the right to appeal and they would have to apply to the Court of Appeal for permission.Keith Oliver, a solicitor acting for Hicks and Gillett, stated: “We are obviously disappointed with the judge’s decision. Mr Hicks and Mr Gillett will now be considering their next steps and that will include whether to make an application to the Court of Appeal.”There were chaotic scenes outside the courts in central London, with more than 100 Liverpool fans surrounding Broughton and singing: “We love you, Martin, we do.”

Security guards tried and failed to move the crowd blocking the entrance as they broke into the Liverpool anthem You’ll Never Walk Alone. On Tuesday, the judge heard how Hicks had tried to block the sale to NESV last week by removing Purslow and Ayre from the board. He had then installed his son, Mack, and business associate Lori McCutcheon so he would have control of voting on the board. But this was in breach of agreements the Americans had signed with the bank when RBS extended its credit facilities. The RBS loan facility ends on Friday and the bank had applied to the court for the injunction to allow the sale to go ahead and recoup its money.Liverpool said in a statement: “We are delighted that the court has clarified the issue of board composition and has removed the uncertainty around the sale process.”We will now be consulting with our lawyers and planning for a board meeting tonight. A further statement will be made in due course.”

Scottish referee Craig Thomson abandons riot-hit Euro 2012 clash as Serbia fans go crazy in Italy

SCOTS ref Craig Thomson had to abandon last night’s Euro qualifier between Italy and Serbia after mayhem erupted in Genoa.

Thomson blew the whistle just six minutes into the Group C clash after seething Serbia fans hurled flares on to the pitch – some of them at their OWN players. It’s being claimed the thugs had always wanted to get the tie called off.The trouble raged all day and Serb yobs attacked their own team bus with fireworks. The supporters – who were protesting at their country’s woeful form – also started running battles with riot police outside the ground. Then kick-off was delayed by 45 minutes as away fans kept up the mayhem.Cops and the Serbia players had to appeal to tooled-up supporters, who booed their own national anthem before smashing up the Luigi Ferraris Stadium.First-choice keeper Vladimir Stojkovic was left so shaken by the bus attack he could not take to the field. Italy coach Cesare Prandelli revealed he found Stojkovic trembling when his squad reached the ground. And he insisted the chaos was premeditated.Prandelli said: “We couldn’t understand why he was in our changing room, then it was explained to us. He was threatened and feared for his safety. Right then realised the game was at risk. Every Serb player knew their fans wanted to suspend the game.”Italy keeper Emiliano Viviano, who was nearly struck by a flare, said: “I couldn’t have played – I would’ve had to constantly turn around to avoid the fireworks. It wouldn’t have been nice to get hit.”Italy are set to be awarded a 3-0 win while UEFA could further hammer the Serbs.

Uefa probes Serbia fan violence

Uefa has launched an investigation into the violent scenes involving Serbia fans which caused their Euro 2012 qualifier in Italy to be abandoned.

Pre-match clashes in Genoa had already delayed the kick-off before the match was called off after only six minutes. The referee and match delegate’s report will be consulted during the process.Possible sanctions from Uefa include a reprimand or fine, stadium closure or even disqualification from current and/or future competitions. The events in Genoa will be discussed at a Uefa meeting on 28 October.

The ultra fans seemed organised. It appeared as though they would have done everything possible to make sure the game was not played

Italy coach Cesare Prandelli

Serbian Football Association chief Tomislav Karadzic said there had been “indications” there would be violence, which he said “brought embarrassment and shame on our country.”Karadzic told Belgrade’s B92 television that the crowd trouble had been planned back home, with the travelling fans being “just the executors.”He added: “We had problems during training, before the match, and now this. The state must react.”Serbia’s ambassador to Italy, Sanda Raskovic-Ivic, said she was appalled by what took place, and apologised on behalf of the country.”What happened in Genoa was a disgrace, a nightmare,” she said.”I and all of the Serbians are ashamed. I take this opportunity to send the apologies from the embassy, our government and our population to the Italian people for what has happened.”Italian police have confirmed 17 arrests were made, 16 of them Serbian.

Widespread trouble caused by Serbian supporters delayed kick-of

Italy, who endured a disastrous 2010 World Cup campaign in South Africa, went into the game with seven points from their opening three qualifiers whereas the Serbs were three points adrift after their shock home defeat by Estonia last Friday. The kick-off at the Luigi Ferraris stadium was delayed after Serbian fans threw flares in the direction of the north stand, where Italian supporters were seated, and on to the pitch. And only six minutes of play was possible before Scottish referee Craig Thomson called a halt to proceedings because of more flares being set off and fireworks being thrown on to the pitch, one of which landed near Italy goalkeeper Emiliano Viviano.Following discussions between delegations from both countries and Uefa officials representatives, the Serbs went back to the dressing room.Although no official announcement had been made at that point about the match being abandoned, the Italians then also left the pitch, applauding their fans as they did so, as the majority of supporters left the stadium.”It was impossible to play in that goal. I would have had to constantly turn around to avoid the fireworks. It wouldn’t have been nice to get hit in the head,” added Viviano.Italian Football Federation security chief Roberto Massucci blamed Serbian authorities for allowing the troublemakers to travel in the first place.

“Fans that are so dangerous should not have arrived in Genoa. They should have been stopped by the Serbian officials,” Massucci said.”We were aware that this game had a risk factor but a behaviour of such aggressiveness we had not experienced for some time.”From the traditional channels of communication with the Serbian police, we had not been given any signs of the degree of danger of these fans.”

Italy coach Cesare Prandelli said he was “sad and bitter” about the way the evening had turned out.”I’ve never experienced anything like this,” Prandelli stated.”The [Serbia] players have been assaulted by their own fans in their bus.”Their goalkeeper [Vladimir Stojkovic] was in our changing room, he was trembling and had fear – not only about tonight but also in view of returning home.”The ultra fans seemed organised. It appeared as though they would have done everything possible to make sure the game was not played. According to the Serbian players, that was their aim.”Sporting Lisbon keeper Stojkovic, who spent a period on loan at Wigan during the 2009-10 season, began his career playing for Red Star Belgrade and is now back in the city on loan at their bitter rivals Partizan.
